1. Introduction

These Terms of Service (“Terms”) govern the provision of design services by Shaun Holding Company Limited (“Shaun Holding”, “we”, “us”). By placing an order, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please refrain from using our services.

 

2. Confirm Order

Steps

a) Provide Design Information: Submit relevant text, images, company information, and references.

b) Request Invoice and Payment: A non-refundable deposit/fee is required to begin.

c) Submit Identity Info: We require your full name, contact information and any required documentation for verificiation, handled per our Privacy Policy.

d) Design Process Starts: Upon payment, the project will begin.

3. Design Process

a) Client Requirements: You must clearly communicate all design needs.

b) First Draft: Once the design order is confirmed, the company will provide a first design draft for customer feedback. Typically, customers can select only one draft for further modification. All other drafts will be considered abandoned. If multiple designs are required, the derivative charges will be based on the scope of service and the specific quotation.

c) Feedback and Revisions: We revise based on your feedback.

d) Final Approval: You must confirm approval in writing within 3 business days. If you do not respond, the design will be considered approved.

4. Our Services

We aim to provide high-quality designs. Any revisions beyond the quotation scope may incur extra fees.

 

5. Customer Responsibilities and Delays

a) Content Responsibility: You are responsible for the legality and accuracy of all content provided. If the content provided by the customer for inclusion in the design is deemed to involve defamation, invasion of privacy, intellectual property infringement, or violates any laws of Hong Kong, Shaun Holding reserves the right to refuse the design or production.

b) Delay by Customer: If required materials are not provided, design services will not begin, even payment has been received.

c) Non-delivery or Uncontrollable Delays: We are not responsible for delays caused by external factors. Shaun Holding shall not be held responsible for non-delivery or delays resulting from factors beyond the company’s control, unintended errors, or unreasonable requests made by customers.

6. Payment Terms and Financials

a) Payment shall be made according to the issued quote or invoice.

b) Payment must be made in full within 3 business days of invoice.

c) Late payments may result in a 3% annual interest charge and suspension of services.

d) Payment of the final invoice constitutes approval of the final design.

e) Cancellation of Ongoing Projects: If an ongoing project is cancelled, Shaun Holding will charge fees based on the work completed up to the point of cancellation. The deposit is non-refundable.

f) Financial Losses: Shaun Holding is not responsible for any financial losses caused by chargebacks or other payment issues initiated by the customer.

7. Intellectual Property Rights

All intellectual property remains with Shaun Holding until full payment is received. Upon full payment, rights are transferred to the client unless otherwise agreed or specified in the contract terms.

 

8. Data Protection

All personal information is handled securely and in accordance with our Privacy Policy. You may request access, correction, or deletion of your personal data.

 

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Hong Kong Special Administrative Region. All disputes will be subject to the exclusive jurisdiction of Hong Kong courts.

 

10. Reference to Additional Terms

Additional terms and conditions may be included in specific quotes or invoices. These documents form part of the binding service agreement.

*** In the event of any discrepancies or inconsistencies between the English and translated versions of the aforesaid policies, including the Privacy Policy, Terms of Use and Terms of Service, the English version shall prevail.
